The question of Liability  & Insurance was recently covered at the GMFC meeting and is reproduced as follows:

As your insurance Chairman I was requested to ask our Insurance Agency to answers some questions on the
Policy, I asked the Agent to answer in basic laymans terms, not get too technical, below is their reply.
It is difficult not to get too technical but I will try. First of all, let me clarify that any claim is subject to
the policy wordings and what I say here is for information only.
Liability insurance covers the named insured if they cause unintentional property damage or bodily in-
jury to a third party. The named insured in this case is the GMFC Society, all Officers and Directors and
member Society’s and member Clubs while action on behalf of the Society. The third party is the in-
jured person. (1st party is the named insured, 2nd party is the insurance company). So if one of the
members physically harms somebody or somebody’s property, the insurance company will pay for
those damages, subject to the policy wordings, exclusions, deductible etc.
The policy also has a very important clause which deletes an exclusion. The exclusion states, “The pol-
icy shall not extend to cover the liability imposed by law upon any member with respect to any other
member”. What this means is that because the insurer has agreed to delete this exclusion, they will
cover if one insured causes harm to another insured. For example if one member was at a dig site and
dropped a bolder on another member, the injured member could sue the one at fault and the policy
would pay the lawsuit (subject to policy wordings, exclusions, deductibles etc)
Question Does this policy extend to cover each clubs workshop? If a guest is in the shop and one of the
members drops a rock on the guest's foot & the guest sued, would there be coverage.
Answer         Yes the liability extends to the individual club workshops
               If the workshop is covered please confirm Tenant Legal Liability limit.
Question
Answer         The Tenant Legal Liability limit is $250,000.
Question A member of our Club in the Club workshop injures himself on the Club equipment. Is he covered with
medical insurance?
Answer: This all depend on how he or she got injured. If they injured themselves and there is no third party at fault
there would be no medical insurance and they would have to rely on MSP or other medical insurance to pay. If the
injury was the fault of another member the injured person could sue for damages and the policy would respond
(subject to policy wordings etc etc)
Question A Club member on a field trip is injured by falling rocks, is that member covered with medical insurance?
Answer: Same as example above.
*note: I think some of your members are confusing medical insurance with liability insurance. The key thing that must
happen for liability insurance to pay is there must be somebody at fault for somebody or something getting injured or
damaged.
Question A Club member on a field trip to a commercial quarry left a hammer on site, the hammer caused damage to
the quarry equipment. Is the Club insured for property damage.
Answer: Yes, Yes!
Question On a Club field trip a group of members car pool, in the event of a vehicle accident are we covered by this
Policy?
Answer: Liability coverage would be covered under the vehicles insurance; however this policy covers “Non-Owned
Automobile liability”. Non-Owned auto covers the organization, club or individual if they are using a car not owned by
them. For example, Mr Stone owns a car in his personal name and he is on his way to the quarry with Mrs Hammer
and Ms Agate. If Mr Stone is at fault in the accident he would be covered by his automobile liability coverage, however
his club or the GMAC could be named in the lawsuit and the club and GMAC would be covered by this policy.
Question
As an Officer of a Club, if being sued by a club member for bodily injury due to a Club activity, am I insured?
Answer: Yes subject as mentions previously.
Also, because this policy is for membership in a club, the liability coverage is secondary to any personal
liability that the individuals would have through their home, condo or tenants insurance.
